To ensure that all our Guests enjoy their visit and get the most from their stay, and to ensure that we comply with all and any local bylaws, including safety regulations, we ask our Guests to support the following ‘Guest Terms and Conditions of Stay’ during occupancy of their room and whilst on the premises of the Houblon Arms. TERMS AND CONDITIONS relating to CAR PARKING, RESERVATIONS and ROOM OCCUPANCY. 1.1 The Guest shall act as agent for all other Guests (if any) in the party (“Group”), and by Booking with The Houblon Arms the Guests confirms that he/she has the authority from the Group to act on its behalf. In so doing individual members of the Group are contracted to these Terms and Conditions of Stay at The Houblon Arms. 1.2 The Houblon Arms acts as an agent on behalf of the owner of the property for the Booking reservation and for all other clauses The Houblon Arms acts as principal to this agreement. 1.3 The Booking reservation shall be subject to Guest Terms and Conditions of Stay at The Houblon Arms and any additional Booking terms which have been notified to the Guest at the time of Booking (“Booking Terms”). In case of conflict, these Guests Terms and Conditions of Stay prevail over any Booking Terms save for any expressly amended, authorised and agreed cancellation rights and payment terms including but not limited to wholesale contracts, meeting and event contracts, corporate rates and online travel agency agreements. No change to these Guest Terms and Conditions of Stay is permitted without the express written consent of The Houblon Arms. 2. BOOKING RESERVATIONS 2.1 Guests must check in from 3pm on the day of arrival. Check out time is 11am. 2.2 Booking reservations cannot be applied to alternative dates, nor extended or reduced without prior agreement with The Houblon Arms. Room types and facilities are specified in the Booking Terms. 2.3 Guest Booking reservations will be retained by The Houblon Arms until 3pm on the arrival date and may be cancelled thereafter by The Houblon Arms without further liability on The Houblon Arms’ part unless The Houblon Arms has agreed otherwise in writing. 2.4 The Houblon Arms reserves the right, at its sole discretion, to release and Booking reservation at any time without charge, penalty, loss or damage if it believes that the Guest is unfit to stay at The Houblon Arms. Unfit can mean being drunk, disorderly, abusive, aggressive or impolite, or causing a danger to other Guests, The Houblon Arms employees and/or contractors. 2.5 Booking reservations are personal to the Guest and cannot be resold or transferred without express written permission by The Houblon Arms. 2.6 For reservations over 3 rooms (“Group Bookings”) please telephone The Houblon Arms directly. 3. CANCELLATIONS 3.1 Cancellations are only valid where made by the Guest in writing to The Houblon Arms more than 3 days prior to stay and must contain the details of the Booking reservation that needs to be cancelled including the Guest name, address and any Booking reservation number. 3.2 A Booking reservation which has not been cancelled by the Guest in accordance with these Guest Terms and Conditions of Stay, and where a Guest does not show up, will be cancelled by The Houblon Arms for any subsequent days and a charge made equal to the value of the stay. 3.3 The Houblon Arms reserves the right to cancel the reservation at any time where: a) The Guests use of The Houblon Arms facilities may, in the reasonable opinion of The Houblon Arms, be prejudicial to the reputation of The Houblon Arms; or, b) In the reasonable opinion of The Houblon Arms, a reservation was made fraudulently or in violation of these Guest Terms and Conditions of Stay or any other Terms applicable to the Guest reservation. Any refund payable in such circumstances is the sole discretion of The Houblon Arms and is subject to any claim for damages. In order to minimise the risk of cancellation Guests are advised to discuss any contentious or controversial purposes of their reservation with The Houblon Arms prior to Booking. 4. CHARGES 4.1 The Houblon Arms will charge the Guest the tariff specified in the Booking Terms. 4.2 Payment is required in advance or upon check-in for the estimated charges for the number of nights. The Houblon Arms reserves the right to refuse entry to the Guest until such pre-payment is received. Should the pre-payment exceed the total charges, The Houblon Arms will refund the balance to the Guest on departure, using the same payment method. 4.3 The Houblon Arms reserves the right to demand payment of amount accruing to a Guests account at any time, and to preclude the Guest from continuing to occupy The Houblon Arms should this demand not be met. 4.4 Should the Guest fail to pay his/her account on demand The Houblon Arms reserves the right to remove the Guests property from their room and to store the same until the account has been paid; for which The Houblon Arms may charge the Guest reasonable storage and administrative costs. The Houblon Arms has a lien on the Guests property which it may sell to pay the account and shall refund any balance to the Guest. The Guest shall indemnify The Houblon Arms for any losses suffered by way of a Guest failing to pay their account. Any continued reservation is contingent upon the Guests pre-payment in cleared funds. 4.5 The Houblon Arms at its discretion use accredited agents for specified services and invoice the agent concerned for these services. The Houblon Arms reserves the right to refuse to accept any vouchers from agents at its sole discretion. The Houblon Arms will not disclose any rates that have been agreed with agents for services provided. Agents may not disclose confidential rates agreed with The Houblon Arms. 4.6 A refundable bond may be charged upon arrival, payable in cash and refundable upon check-out, where more than 1 room is occupied by the same Group. This bond is to cover any damage caused, accidentally or deliberate, to fixtures, fittings and facilities. The bond will be withheld if any damage has been caused, or if the rooms have been left in an unreasonable state of cleanliness which requires more than a reasonable clean to return it to the standard it was upon arrival. 5. CONDITIONS ON WHICH A GUEST MAY OCCUPY A ROOM 5.1 Subject to these Guest Terms and Conditions of Stay, the Guests shall occupy the room as a bare licensee only and no relationship of landlord and tenant shall be created by the Guests sue of the room. The Houblon Arms retains control, possession and management of the room and the Guest agrees that s/he shall not have exclusive possession of the room. The Houblon Arms may in its absolute discretion move the Guest and/or allow The Houblon Arms employees access to service, repair, tidy and clean the room at any time. 5.2 It is a condition precedent that the Guest may only occupy the room following check-in where s/he has provided advance payment. Only those Guests to whom the room is allocated may occupy the room. Guests are not permitted to resell or transfer their Booking. The Houblon Arms will use reasonable endeavours to ensure that a room is available for occupation by the Guest at the stated check-in time. 5.3 During occupancy and whilst on The Houblon Arms grounds the Guest will not; a) Make excessive noise b) Damage or remove The Houblon Arms property, whether in the room or on any part of the grounds. Any damage or removal will be paid for by the Guest and amounts to be paid shall be at the sole discretion of The Houblon Arms, c) Leave the room in a disorderly state or such state as will cause distress to the cleaners, d) Use any electrical appliance other than those supplied or approved by The Houblon Arms, in particular electric water heaters, cooking devices, and equipment greater than 3kWh or, where stated, greater than the kilowatts stated on the particular socket, e) Smoke in any room or on the Houblon Arms premises except in designated smoking areas, f) Park a car or vehicle otherwise than as agreed by The Houblon Arms or cause obstruction around the grounds of The Houblon Arms, g) Bring or allow in their room any person other than those allocated to the room and will cooperate with The Houblon Arms in having such persons removed, h) Enter or occupy a room which has not been allocated to them, or obstruct any common parts of The Houblon Arms, i) Interfere with other Guests, their property or their enjoyment of a peaceful stay at The Houblon Arms, j) Bring onto The Houblon Arms any animal or pet other than guide dogs, k) Do or permit anything which is illegal or which may become a nuisance including the infringement of any third party intellectual property rights, in particular whilst using The Houblon Arms internet connection, l) Ignore or violate Health and Safety Regulation displayed at The Houblon Arms. 6. CAR PARKING TERMS 6.1 Subject to this clause and upon request by the Guest, The Houblon Arms permits the Guest to use such car parking Space as The Houblon Arms may in its sole discretion allot to the Guest (“Space”) for the duration of the Guests stay at The Houblon Arms. 6.2 The Guest acknowledges that the occupation of the Space by the Guest is a bare licensee only and no relationship of landlord and tenant shall be created by the Guests use of the Space. The Guest also agrees that s/he shall not have exclusive possession of any Space. The Houblon Arms may in its absolute discretion request that the vehicle is moved by the Guest, for an example in order to perform repairs and to clean the Space. 6.3 Vehicles are parked at the Guests own risk and The Houblon Arms cannot guarantee the security of the vehicle and its contents. Guests are advised to ensure that vehicles are locked securely, that all windows are securely closed and possessions left out of sight, and that the vehicles alarm is engaged. Please contact The Houblon Arms prior to Booking to determine any height or other restrictions. 6.4 The Guest shall; a) Drive carefully in The Houblon Arms grounds and not obstruct entrances or exits, including parking in the allocated parking areas only, b) Not make any alteration to the Space nor cause any damage to The Houblon arms or to any property of the owners. Any damage caused shall immediately be reported to management and damages caused to another vehicle should be reported by the Guest to the owner of the vehicle, c) Not display any advertisement or notices in the Space and not conduct any business activity on the grounds of The Houblon Arms, for example in connection with selling, hiring or other disposal of vehicles or goods and services, d) Not cause any nuisance or inconvenience, deposit rubbish other than in the proper receptacles, nor pour or transfer fuel on the grounds, 7. TERMINATION 7.1 This agreement and any licenses granted within shall end on the earlier of: - The date and time upon which the Guest checks out of The Houblon Arms, finishes the use of the allotted parking areas or otherwise the accommodation services ordinarily cease, - The Houblon Arms gives notice of termination with immediate effect if the Guest breaches any of the Guest Terms and Conditions of Stay at The Houblon Arms. 8. LIMITATION OF LIABILITY AND DISCLAIMERS 8.1 Guests are advised to be adequately insured, to be vigilant and to take reasonable care over the property generally and especially in areas accessible to the public as The Houblon Arms is not responsible for theft, loss or damage caused by third parties outside their control. 8.2 For the avoi8dence of all doubt The Houblon Arms does not accept liability for theft, loss or damage caused to any vehicle or its contents whilst parked on The Houblon Arms property and as such any vehicles and contents are left entirely at the Guests own risk. 8.3 A $200 fee shall be charged for smoking in any of the rooms as this is not permitted. 8.4 The Guest shall keep The Houblon Arms indemnified in full against all direct, indirect or consequential liabilities, loss, damages, injury, costs and expenses awarded against or incurred or paid by The Houblon Arms as a result of, or in connection with: a) The Guests breach of the Guests Terms and Conditions of Stay, b) Any infringement of any intellectual property rights by the Guest during the stay at The Houblon Arms, c) Any damage caused to the premises (or contents) of The Houblon Arms whether or not owned by The Houblon Arms caused by the Guest. 9. DATA PROTECTION 9.1 Except as set out above The Houblon Arms will not use Guest information given for any other purposes unless the Guest agrees, or unless The Houblon Arms is required or permitted to do so by law. By agreeing to the Guest Terms and Conditions of Stay and making a confirmed Booking, the Guest is signifying their consent (and that of their Group) to their personal data being processed in accordance with the above statement. 10. GENERAL 10.1 These Guest Terms and Conditions of Stay are governed by the laws of England and Wales and each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this agreement or its subject matter or formation (including non-contractual disputes or claims).
